Injury help in downtown and central Fort Wayne

Downtown Fort Wayne is where most of the firms in this site’s law firm directory keep their offices, and it is a place where many people spend their working day. This page is for anyone hurt in the central city, in the 46802 and 46803 ZIP codes and the streets around them, and for anyone who simply wants to know which injury law firms have downtown offices.

Law firm offices in the central city

Of the firms in the directory of Fort Wayne personal injury law firms, more than half list a downtown address. Their offices sit on streets like East and West Berry Street, East Main Street, South Calhoun Street, East Wayne Street and West Jefferson Boulevard, with one firm on Broadway just outside the core. Each listing shows the firm’s own address, phone and website, so you can call a firm directly and ask whether a meeting downtown suits you.

An office close to where you work or live can make it easier to drop off papers or sit down in person. It is only one factor, though. Who handles your file, how the fee works, and how well the firm explains things to you matter more than the street it is on.

Hurt on a sidewalk or in a public building

Downtown streets include a good deal of public property, such as sidewalks and government buildings. An injury there can involve a city, the county or the state, and Indiana treats those claims differently from a claim against a store or a private landlord.

  • A written notice comes first. For a claim against a city, town or county, Indiana generally requires a tort claim notice filed with that body’s governing board within 180 days after the loss. For the State of Indiana, it is 270 days, filed with the attorney general or the state agency involved.
  • The notice has set contents. It must describe the facts and circumstances, the extent of the loss, the time and place, the people involved if known, the amount of damages sought and the claimant’s residence.
  • Fault rules differ. Different fault rules can apply to claims against a government unit.
  • There are limits. Indiana caps the combined liability of government bodies and public employees and rules out punitive damages against them.

The rules are in Indiana Code 34-13-3, and our article on the Indiana tort claim notice walks through them. If you fell on a downtown sidewalk or in a public building, the slip and fall guide covers what to photograph and keep.

Walking downtown

Plenty of downtown trips happen on foot, between a parking spot, an office and a lunch place. The Northeastern Indiana Regional Coordinating Council’s 2023 safety plan lists Jefferson Boulevard among Allen County streets with recorded pedestrian crashes, 24 of them from 2009 to 2020. If you were hit while walking, the road crash rules apply alongside the injury rules on this site; a lawyer can explain how they fit together. If anyone is hurt, call 911 first.

Where an injury case is filed

When an injury claim from Fort Wayne goes to court, it is generally filed in the Allen Circuit Court or the Allen Superior Court, the main trial courts for the county and part of the Indiana state court system. The Clerk of the Circuit and Superior Courts keeps the official records. According to the Allen County Clerk, you can look up Allen County cases on mycase.IN.gov by choosing Allen County.

Indiana law generally allows two years to start an injury lawsuit, and some claims have shorter or different deadlines. A licensed Indiana attorney can tell you which applies to your situation.

Getting ready for a first meeting

Whether you reach an attorney’s office through the referral line or call a firm from the directory, a little preparation helps the first conversation go further:

  • A short written timeline: date, time, place and what happened.
  • Photos of the place and your injuries.
  • Names of witnesses and anyone you reported the injury to.
  • Medical records and bills you have so far.
  • Letters or emails from any insurer, and anything you were asked to sign.
  • Your questions, written down, including how the fee is figured.

Downtown parking and timing can be part of the plan too, so ask the office where to park or whether a phone or video meeting works for the first talk.
